ONGC has been pioneer in the introduction of a system for resolution of disputes by conciliation/mediation process by an Outside Expert Committee (OEC), which is a voluntary process conducted in a cost effective & timely manner. We believe that mediation is the flagship of the Alternate Dispute Resolution (ADR) movement. In mediation/conciliation, the emphasis is on cooperation and communication, on sustainable solutions based on fairness & reasonableness, this is a win-win for all parties.
We had a good experience of the overall OEC process for S1 Vashistha project. The OEC members were very knowledgeable and patiently listened/examined the case for both the parties. After 10 hearings the result was announced in timely fashion
MoPNG has appreciated OEC policy of ONGC and advised that Administrative Ministries/ Departments/ CPSEs may consider introducing conciliation procedure involving experts, as is done by ONGC & appreciated the model ONGC has adopted
The OEC process is a well thought- out and an excellent and speedy recourse to any contractual dispute resolution as compared to the conventional dispute resolution mechanism like Arbitration or Judicial process. Our experience with the OEC dispute resolution process is that it is very fair and considers both the view points.
Asia Pacific Center for Arbitration and Conciliation (APCAM) at its first international ADR summit held on 6-7th May, 2023 bestowed ONGC with award for being the “Leading Alternative Dispute Resolution (ADR) User 2023” for its contributions to ADR through conciliation.
